On March 28, 2025, the Secretary of Labor and Social Welfare published in the Official Gazette of the Federation the update to NOM-017-STPS-2024, regarding Personal Protective Equipment (“PPE”): selection, use and handling in workplaces.
This norm establishes several updates to the provisions regarding PPE, particularly regarding the obligations of the companies, which consist of:
(i) Providing periodic training to employees on proper equipment and its correct use
(ii) Provide PPE in accordance with the requirements established by the applicable NOMs, according to the specific activity;
(iii) Verify that the PPE is certified by a certification agency, when NOMs exist for this equipment;
(iv) Provide PPE for visitors to the work center;
(v) Maintain an updated record of the delivery, use and training on PPE; and
(vi) Ensure that employees of specialized services or works are aware of the risks, safety measures and proper use of PPE, as well as supervise their compliance, among others.
Besides, the norm grants companies the option to hire an accredited and approved inspection unit to evaluate compliance with these provisions, in accordance with the Quality Infrastructure Law. Such unit may issue an opinion with a validity of two years, provided that the conditions that served as the basis for its issuance are not modified.
NOM-017-STPS-2024 will enter into force six months after its publication, that is, in September 2025.
