This June 17, 2025, the amendment to several provisions of the Federal Labor Law, which incorporates the obligation for workplaces to provide adequate seating for employees, thus preventing them from standing unnecessarily or for a prolonged period of time during their working day, enters into force.
This legislative amendment, commonly referred to as the “Chair Law”, represents a regulatory advance aimed at protecting health and safety in the workplace, with special emphasis on the principles of ergonomics and labor dignity. It recognizes that prolonged and forced posture can have a significant impact on the physical health of employees, which fully justifies its regulation in the Mexican labor law.
Pursuant to the amendment decree published in the Official Gazette of the Federation on December 19, 2024, as of its entry into force, the labor authority will have 30 calendar days (i.e., until July 17, 2025) to issue technical guidelines and criteria to guide workplaces in the correct implementation of this new obligation.
On the other hand, a period of 180 calendar days is established, starting on June 17, for employers to make the necessary adjustments to their internal regulations, infrastructure and working conditions, so that effective compliance with the provision is guaranteed by December 14, 2025.
Our firm remains attentive to the issuance of the criteria by the labor authority and is prepared to provide legal and technical support to companies in the progressive compliance with this obligation, in order to mitigate risks and promote safe working environments and respectful of labor rights.
